All models or performers shown in images or videos on the website found at smalltits.pics were no younger than 18 years of age when the images or videos were created.

Exemption: Content Produced by Third Parties

smalltits.pics is not a "producer" (primary or secondary) of any visual matter depicting real or simulated sexual conduct, explicit or otherwise, found on the website. The actions of owners and operators of the website are limited to the transmission, storage, retrieval, hosting, or formatting of content, which may be sexually explicit, that is contributed by third-party users. All parts of smalltits.pics on which user-furnished content appears are under said users’ control. The operators are therefore exempt from compliance with Section 2257 records keeping and labeling obligations as specified in 28 C.F.R. §75.1(c)(4). Any content that is deemed illegal, obscene, harmful, harassing, defamatory or in any way incompatible with the terms of use and policies of the website, may be removed at the sole discretion of the operator or owner, pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).

Exemption: Content Produced by Website Operator

Any visual depictions that may appear on the website, for which the operator of the website may be regarded as the “producer,” are excluded from compliance with the conditions of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons: (1) the images or videos do not include any sexually explicit acts as defined in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not include depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not include simulated sexually explicit behavior; or (4) the images or videos were produced before July 3, 1995.
